Data processing
As a result of an application, AquaDuna processes the information provided to us as part of the application process. Relevant information includes, in particular, contact details, details of training, qualifications, work experience and other knowledge and skills.
Applicant data is processed exclusively for the purpose of carrying out the application procedure. If the application is successful, this data becomes part of the personnel file. If an employment relationship is not established, we process the data for up to 6 months after the rejection. This enables us to take a well-founded position with regard to any legal claims, such as allegations of disadvantage or discrimination.
The HR department and the management have access to applicant data. In addition, IT administrators and order processors have the possibility to access digitally processed data for technical reasons. They are strictly bound by our instructions under data protection law and may not use the data for their own purposes.
The legal basis for data processing in the application process and as part of the personnel file is Section 26 (1) sentence 1 BDSG and Article 6 (1) (1) (b) DSGVO and, insofar as you have given your consent, for example by sending information not required for the application process, Article 6 (1) (1) (a) DSGVO. The legal basis for data processing after a rejection is Art. 6 para. 1 /para. 1 lit. f DSGVO. A legitimate interest in processing based on Art. 6 para. 1/para. 1 lit. f DSGVO is the defence against legal claims.
As a matter of principle, we do not require any categories of personal data pursuant to Art. 9 DSGVO for the application process and ask that no such information be provided. If such information is exceptionally relevant for the application process, we process it together with other applicant data. This may concern information about any severe disability that is voluntarily provided to us and which we need to process in order to fulfil our specific obligations towards severely disabled persons. In these cases, the processing serves the exercise of rights or the fulfilment of legal obligations arising from labour law, social security law and social protection.
